MUMBAI: Trial in Malegaon blast case saw 39 witnesses turn hostile, retracting earlier statements and casting doubt on crucial elements of the prosecution's case. Since 2021, several witnesses appearing before the NIA court denied prior testimonies, often alleging coercion or fabrication by agencies, particularly the ATS.
Acquitting all seven accused Thursday, judge A K Lahoti said prosecution witness testimonies were riddled with inconsistencies and contradictions. "Such discrepancies undermine credibility of prosecution's case. The witnesses have retracted from their earlier statements given to ATS. Therefore, neither conspiracy is proved nor meetings are proved," the judge observed.
Of the 71 witnesses cited against Lt Col Purohit, around 20 did not support the case.
A two-wheeler agent, key to linking the bomb-laden bike, became uncertain during cross-examination. While he initially told police he sold a Hero Honda with a particular number, he later claimed he couldn't remember it. The prosecution said forensic evidence backed his earlier version.
An angadia staffer denied knowledge of financial dealings involving accused Ajay Rahirkar. Several witnesses, including ex-army officers, alleged ATS forced them to implicate Purohit. Prosecution argued retractions were deliberate, aimed at aiding the accused.
